New Delhi: The Supreme Court has agreed to hear next week a Public Interest Litigation challenging the functioning of Chief Election Commissioner (CEC) Gyanesh Kumar. The petition seeks to restrain Gyanesh Kumar from functioning as the Chief Election Commissioner. The matter was mentioned before a bench headed by Chief Justice Surya Kant on Tuesday. Justices Joymalya Bagchi and V. Mohana are also part of the bench. The Supreme Court’s official listing notices confirm oral mentioning matters before the court on September 29.

Questions Raised Over Election Commission Decisions

Senior advocate Vikas Singh, while presenting the matter before the bench, said that under the statutory framework, decisions of a multi-member Election Commission should be taken unanimously or on the basis of a majority. The petition alleges that under the leadership of the Chief Election Commissioner, the Commission took certain decisions without the approval of the two Election Commissioners.

Challenge Also Related to SIR

According to reports, the petition challenges not only the functioning of the Election Commission but also the Special Intensive Revision (SIR) being conducted across the country. The petitioner has claimed that some decisions related to SIR were taken without the knowledge or recommendation of other members of the Commission. The legality of these claims will now be considered by the Supreme Court.

Hearing to Take Place in the Supreme Court Next Week

The Supreme Court has agreed to hear the matter next week. The available Supreme Court records show the bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana on September 29. The upcoming hearing will consider the legal questions raised in the petition and the claims related to the Election Commission’s decision-making process.
